The main functions of the Department of Customs Investigations and Inquiries:

  • organization, methodological guidance, coordination and control of the activities of customs authorities for the consideration of reports and materials containing information on signs of crimes attributed to the competence of customs authorities, and making decisions in accordance with the criminal procedure legislation of the Russian Federation; for the production of urgent investigative actions and the implementation of a preliminary investigation in the form of an inquiry in criminal cases related to the competence of customs authorities in accordance with the criminal and criminal procedure legislation of the Russian Federation; on conducting administrative proceedings in cases referred to the competence of customs authorities; on observing the legality and validity of decisions, actions (inaction) of customs authorities and their officials when bringing persons to administrative responsibility;
  • consideration of reports and materials containing information on signs of crimes attributed to the competence of customs authorities and decision-making in accordance with the Criminal Procedure Code of the Russian Federation;
  • the implementation of a preliminary investigation in the form of an inquiry, as well as the production of urgent investigative actions in criminal cases referred to the competence of customs authorities; \
  • organization of execution in accordance with the procedure established by the criminal procedure legislation of the Russian Federation, the instructions of the prosecutor, the instructions of the preliminary investigation bodies;
  • organization of work on participation on the basis of a prosecutor's decision in the work of investigative groups established to investigate crimes within the competence of customs authorities;
  • the initiation of cases of administrative offenses attributed to the competence of customs authorities, the implementation of administrative proceedings in accordance with the procedure provided for by the Code of Administrative Offenses of the Russian Federation;
  • management of the activities of operational customs in terms of the organization of administrative proceedings and inquiries, forensic support and accounting and registration discipline;
  • preparation of proposals for the leadership of the Federal Customs Service of Russia on the validity and necessity of extending the period of administrative investigation in cases of administrative offenses;
  • organization of forensic support in the implementation of administrative proceedings, when the customs authorities review decisions on cases of administrative offenses in connection with complaints of persons or protests of the prosecutor, as well as in the conduct of urgent investigative actions and inquiries in criminal cases referred to the competence of customs authorities; coordination and control of the activities of forensic units of customs authorities;
  • participation in the development of a system of measures for the prevention of crimes and other administrative offenses in the field of customs affairs and ensuring the participation of customs authorities in the implementation of such measures;
  • control over the observance of legality by officials of the Department and customs authorities in the conduct of urgent investigative actions and inquiries in criminal cases referred to the competence of customs authorities, and in the implementation of administrative proceedings;
  • conducting inspections in connection with complaints from individuals and acts of prosecutorial response to the legality and validity of: - resolutions on cases of administrative offenses; - decisions of the customs authorities taken during the proceedings on administrative offenses;
  • conducting inspections of the organization of work to monitor compliance with the legality and validity of decisions, actions (inaction) of customs authorities and their officials when bringing persons to administrative responsibility;
  • analysisthe state of legality in the customs authorities and the generalization of the practice of applying legislation on administrative offenses. Preparation (including jointly with interested structural divisions of the Federal Customs Service of Russia) of draft legal acts of the Federal Customs Service of Russia, reviews, information letters and recommendations on monitoring compliance with legislation when bringing persons to administrative responsibility and law enforcement practice;
  • informing individuals and legal entities about the procedure for appealing and consideration by customs authorities of complaints against decisions, actions (inaction) when bringing persons to administrative responsibility.
  • development of reporting forms for operational customs on their activities to monitor compliance with the rule of law;
  • holding meetings and seminars with officials of law enforcement units to exchange work experience, organize events aimed at improving the skills of customs officials on compliance with legislation on administrative offenses;
  • organization and control of work planning, reporting on the results of official activities in the relevant law enforcement units of customs authorities;
  • organization of information and analytical support for the activities of relevant law enforcement units of customs authorities;
  • providing the Deputy head of the Federal Customs Service of Russia, who oversees the operational search work of customs authorities, with information on the status, progress and results of administrative proceedings, urgent investigative actions and inquiries;
  • organization, methodological guidance, coordination and control of the activities of accounting and registration units of customs authorities;
  • improvement of the system of measures ensuring uniform and correct application by customs authorities of legislation on administrative offenses, customs and other legislation when bringing persons to administrative and criminal responsibility;
  • identification of legal problems in the activities of customs authorities during the investigation of criminal cases referred to the competence of customs authorities, as well as in the implementation of administrative proceedings. Preparation and submission to the management of the Federal Customs Service of Russia of proposals on improving the legislation of the Russian Federation in terms of Management competence;
  • sending proposals to the prosecutors of the constituent entities of the Russian Federation on making protests on the cancellation or amendment of illegal or unjustified decisions issued by customs officials in cases of administrative offenses referred to the competence of customs authorities;
  • preparation, within the competence of the Department, of proposals for the publication, cancellation, amendment or addition of regulatory legal acts of the Federal Customs Service of Russia;
  • generalization and analysis of the law enforcement practice of the Department, customs authorities, as well as judicial authorities on issues within the competence of the Department;
  • participation, together with other structural divisions of the Federal Customs Service of Russia, in representing the interests of the Federal Customs Service of Russia and customs authorities in courts of general jurisdiction and arbitration courts when considering cases of administrative offenses, as well as in connection with appealing decisions, actions (inaction) of customs officials in conducting administrative proceedings;
  • interaction with structural divisions of the Federal Customs Service of Russia on issues related to the competence of the Department;
  • organization and coordination of interaction between customs authorities and law enforcement, judicial and regulatory authorities on issues within the competence of the Department;
  • participation in the training, retraining and advanced training of officials of the customs authorities of the Russian Federation on issues related to the competence of the Department;
  • ensuring timely and complete consideration of proposals, applications and communications received by the Federal Customs Service of Russia from law enforcement, regulatory and other government agencies, as well as citizens' appeals on issues within the competence of the Department, sending responses to applicants within the time limit established by the legislation of the Russian Federation;
  • participation, within the competence of the Department, in the implementation of customs development programs in the Russian Federation;
  • participation, within the competence of the Management, in the application of the risk management system;
  • implementation, in accordance with the legislation of the Russian Federation, of work on the acquisition, storage, accounting and use of archival documents formed during the activities of the Department.
