Narcotic drugs, psychotropic substances and their precursors, the import and export of which to the customs territory of the Customs Union is allowed on the basis of a license

Note:

The attribution of a substance to the corresponding narcotic drug, psychotropic substance or their precursor included in this list does not depend on which brand (trade) names, synonyms or abbreviations are used as its name.

In respect of combined medicinal products containing, in addition to the drugs or substances included in this list, other pharmacologically active components, control is established individually by including this combined medicinal product in this list.

The concentration of substances specified in this list is determined based on the mass fraction of the substance in the mixture (solution).

For the purposes of using this list, it is necessary to be guided by both the TN codeForeign economic activityvehicle, as well as an international unregistered or other unscientific name or a chemical name or a short description of a narcotic drug, psychotropic substance or their precursor.

Regulations on the procedure for the import into the Customs Territory, Export from the Customs Territory and Transit through the Customs Territory of the Customs Union of Narcotic drugs, Psychotropic Substances and their Precursors

In the Russian Federation, the Federal Drug Control Service of the Russian Federation (FSKN of Russia) and the Federal Service for Supervision of Drug Trafficking are authorized federal executive authorities to coordinate applications for licenses and other permits for the import and export of narcotic drugs, psychotropic Substances and their precursors in trade with third countries. 1. The Regulation on the procedure for the Import into the Customs territory, Export from the Customs territory and Transit through the Customs Territory of the Customs Union of Narcotic Drugs, Psychotropic Substances and Their Precursors (hereinafter referred to as the Regulation) was developed in accordance with the Agreement on Licensing Rules in the Field of Foreign Trade in Goods dated June 9, 2009 (hereinafter referred to as the Agreement) and the Agreement on the Procedure for the Introduction of and the application of measures affecting foreign trade in goods in the single customs territory with respect to third countries dated June 9, 2009.
2. The regulation applies to legal entities that import into the customs territory, export from the customs territory ortransitin the customs territory of the Customs Union of narcotic drugs, psychotropic substances and their precursors specified in Section 2.12 of the Unified List of Goods to which prohibitions or restrictions on import or export by the member States of the Customs Union within the framework of the Eurasian Economic Community in trade with third countries (hereinafter referred to as applicants), as well as on individuals engaged in import or export of such goods for personal use.
3. The import and (or) export by legal entities of narcotic drugs, psychotropic substances and their precursors is carried out on the basis of one-time licenses issued by the authorized state body of the member state of the Customs Union in whose territory the applicant is registered (hereinafter referred to as the authorized body).
4. Individuals may import and (or) export limited quantities of narcotic drugs and psychotropic substances in the form of medicines for personal use for medical reasons, subject to the availability of relevant documents, as well as precursors in the amounts determined by the legislation of the member State of the Customs Union.
5. The transit of narcotic drugs, psychotropic substances and their precursors through the territories of the member States of the Customs Union is carried out in compliance with the provisions provided for by international treaties of the member States of the Customs Union in the sphere of turnover of controlled drugs and substances specified in Section 2.12 of the Unified List of Goods to which prohibitions or restrictions on import or export by the member States of the Customs Union apply within the framework of the Eurasian Economic Community in trade with third countries.
6. The issuance by the authorized body of licenses for the import and (or) export of narcotic drugs and psychotropic substances is carried out taking into account the needs of the member State of the Customs Union in narcotic drugs and psychotropic substances.
7. To issue a license, the applicant submits to the authorized body the documents provided for in paragraph 3 of Article 3 of the Agreement.
   When exporting narcotic drugs, psychotropic substances and their precursors, the applicant submits to the authorized body an import permit (original or its notarized copy) issued by the competent authority of the importing country.
   When transiting narcotic drugs, psychotropic substances and their precursors through the customs territory of the member States of the Customs Union, the applicant additionally submits to the authorized body an import permit (original or its notarized copy) issued by the competent authority of the importing country and a copy of the export permit of the exporting country, unless otherwise provided by the requirements of the importing country.the importer or exporting country.
8. If, in accordance with the legislation of a member state of the Customs Union, the decision to issue a license is made by the authorized body in coordination with other executive authorities of a member state of the Customs Union, the applicant, in addition to the documents specified in paragraph 3 of Article 3 of the Agreement, submits to the authorized body documents of executive authorities confirming the possibility of import and (or) export of narcotic drugs, psychotropic substances and their precursors.
   The term of consideration of documents submitted to the coordinating body is determined by the member State of the Customs Union.
9. The issuance of a license and documents confirming the possibility of import and (or) export of narcotic drugs, psychotropic substances and their precursors, in addition to the grounds specified in paragraph 6 of Article 3 of the Agreement, may be refused in case of failure to submit the documents provided for in paragraphs 7 and 8 of this Regulation, as well as in case of exceeding the norm of the need for narcotic drugs, psychotropic substances and their precursors, established for a member state of the Customs Union.
10. Import and (or) export, as well as transit of narcotic drugs, psychotropic substances and their precursors intended for emergency assistance in emergency situations, is carried out without a license in accordance with the legislation of a member State of the Customs Union.
11. The applicant of a member state of the Customs Union is obliged, within 10 calendar days from the date of import (export) of narcotic drugs, psychotropic substances and their precursors, to notify the authorized body of the country that issued the license about the quantities of narcotic drugs, psychotropic substances and their precursors actually imported (exported), the type of vehicle that was used for their import (export), as well as the place and date of movement of cargo across the customs border of the Customs Union.
12. The import and (or) export of limited quantities of narcotic drugs, psychotropic substances and their precursors in first aid kits on sea (river) ships, international aircraft for first aid is carried out without a license with the use of control measures defined by the legislation of the State of registration of the relevant vehicles.
    The import and (or) export of precursors used as supplies in the amount necessary to ensure the normal operation of equipment and technical devices of an air, sea (river), railway vehicle is carried out without a license in compliance with the requirements of customs legislation regulating the movement of supplies across the customs border.
13. The authorized body has the right to issue explanations (conclusions) on the issues of issuing licenses. Information on the issued clarifications (conclusions) is sent to the Eurasian Economic Commission.
